To activate Mark of Pain you need to be dealing "physical" damage, if I remember correctly - I don't have that one unlocked yet so I can't check on it. That means damage from a sword, axe, bow, or hammer, basically, and even then you could be doing elemental damage with one. If you're just using a wand, you won't be triggering Mark of Pain as most wands already have typed damage (this didn't use to be the case or, at least, weapon damage regardless of it's "type" always counted as physical).
